LEGAL / DRAFT — NOT FINAL
Terms of Service
Last updated: October 19, 2026
DRAFT — Not legally reviewed. This document contains unconfirmed details and policy decisions. Items marked [TO BE COMPLETED BEFORE LAUNCH] must be resolved before launch.
1. Draft status and business identity
These draft Terms describe the proposed B2B services offered under the Listing Film Works brand at listingfilmworks.com. The operator is a Slovakia-based sole trader whose registration details have not been finalized.
Legal operator name, registration number, registered business address, VAT status/number (if applicable), required commercial disclosures, and effective date: [TO BE COMPLETED BEFORE LAUNCH]. These Terms have not been legally reviewed and are not a finalized launch-ready agreement.
Contact: support@listingfilmworks.com.
2. B2B services and eligibility
Listing Film Works provides white-label real estate video production for real estate photographers and real estate media businesses, primarily serving US-based customers. Production uses customer-supplied property photos and AI-assisted tools.
The service is intended for business use. You should be authorized to place the order and supply the project materials on behalf of your business. Eligibility, the treatment of any non-business customers, and any mandatory protections require confirmation: [TO BE COMPLETED BEFORE LAUNCH].
3. Packages and optional add-on
The current package choices are Trial Film ($29), Listing Film ($49), Signature Film ($79), and Estate Film ($119). An optional vertical 9:16 Social Reel add-on is $29; it is not a separate film package. Monthly volume arrangements are handled through a separate inquiry process.
The confirmed scope, deliverables, formats, duration, photo requirements, trial eligibility, included revisions, currency designation, taxes, and any other applicable charges must be settled before acceptance: [TO BE COMPLETED BEFORE LAUNCH]. No unconfirmed fee or package entitlement is created by this draft.
4. Order submission, acceptance, and payment
The /order form submits an order request and the property materials link. It does not collect payment. A submission confirmation acknowledges receipt; it does not confirm that the project has been accepted, scheduled, or paid.
We review the requested package and materials and confirm next steps by email. The point at which an order becomes binding, how acceptance is communicated, payment methods, invoice arrangements, due dates, and payment requirements are [TO BE COMPLETED BEFORE LAUNCH]. Do not assume production has started until the order and applicable requirements have been confirmed.
5. Property photos and instructions
Provide a downloadable link to the photos for the specific property being ordered, not a general business portfolio. Ensure we can access and download the original high-resolution images without requesting permission. Google Drive, Dropbox, WeTransfer, or a property delivery gallery may be used; check link permissions and expiry dates.
Supply complete, usable photos and clear production instructions. Do not expose unrelated client folders or unnecessary personal information. Missing, low-quality, inaccessible, or incomplete materials may prevent production or delay confirmation. Technical requirements and procedures for unsuitable materials are [TO BE COMPLETED BEFORE LAUNCH].
6. Rights and authorization
You are responsible for ensuring you have the necessary rights and permissions to provide the photos, branding, music or other materials you supply and to authorize the intended production and use. This includes any relevant photographer, client, property, privacy, or third-party permissions.
The precise permission granted to Listing Film Works and its production providers to access, copy, process, and transform supplied materials—including the use of AI tools—must be confirmed: [TO BE COMPLETED BEFORE LAUNCH]. This draft does not transfer ownership of your source materials or establish an indemnity.
7. AI-assisted production
AI-assisted production can introduce artifacts, interpretive movement, or visual differences from the source photos. Source-image quality and available visual information can limit results. Films should not be relied on as an exact measurement, survey, or guarantee of property condition.
Review the finished film for accuracy and suitability before use in property marketing. Permitted alterations, prohibited or misleading content, disclosure obligations, quality review, and the process for addressing material errors are [TO BE COMPLETED BEFORE LAUNCH].
8. Delivery timelines
Any advertised 24-hour delivery promise applies only after order acceptance, receipt of all complete and usable materials, and any required payment. An automatic form receipt alone does not start the delivery period.
The start-time confirmation, applicable time zone, treatment of weekends and holidays, pauses for clarification, service availability, and remedies for delays require confirmation: [TO BE COMPLETED BEFORE LAUNCH]. No additional delivery guarantee or automatic refund is created by this draft.
9. Revisions, cancellations, and refunds
Revision scope, included rounds, request deadlines, additional work, cancellation rights, production cut-off points, refunds, and treatment of unworkable source materials are [TO BE COMPLETED BEFORE LAUNCH].
These policies must be confirmed and communicated before orders are accepted. This draft does not establish a “no refunds” policy or remove any mandatory rights.
10. White-label use, ownership, and licensing
The service is designed for delivery under the customer’s brand. Exact ownership of final films, license scope, resale and client-delivery permissions, restrictions, payment conditions for rights, third-party asset rights, and rights relating to AI-assisted outputs are [TO BE COMPLETED BEFORE LAUNCH].
Portfolio use, testimonials, attribution, promotional use of customer work, and any permission or opt-in process are also [TO BE COMPLETED BEFORE LAUNCH]. No portfolio permission or transfer of ownership is assumed by this draft.
11. Confidentiality and data handling
Property materials and business instructions may be confidential or contain personal data. Confidentiality duties, permitted disclosures to production providers, exclusions, duration, data-processing roles, and any required data-processing agreement are [TO BE COMPLETED BEFORE LAUNCH].
See the separate draft Privacy Policy for the proposed information-handling framework. Do not submit sensitive or unrelated personal information. This paragraph is not a finalized confidentiality or data-processing agreement.
12. Liability and service limitations — legal review required
Any warranties, exclusions, liability limits, remedies, insurance provisions, indemnities, or exceptions must be drafted for the actual business and reviewed for enforceability: [TO BE COMPLETED BEFORE LAUNCH]. No liability cap, blanket disclaimer, or waiver is established here, and nothing in this draft is intended to exclude rights that cannot lawfully be excluded.
13. Disputes, applicable law, and updates
The complaint and dispute-resolution process, cancellation procedure, governing law, jurisdiction, and any applicable mandatory rules are [TO BE COMPLETED BEFORE LAUNCH]. No governing law or court is selected in this draft.
How updates are notified and apply to existing orders must also be confirmed. Questions about an order or these draft Terms can be sent to support@listingfilmworks.com.
